When Can I Finally Fire the Absent Employee?

The Americans With Disabilities Act Amendments Act, Family and Medical Leave Act and Worker’s Compensation all have accommodation components or provisions that relate to employment protection or continuation.  We will provide an in-depth look at the likely expansion of leave of absence rights as they relate to the ADAAA and the FMLA and how, when appropriate, Worker’s Compensation provisions should be considered. 
Effectively monitoring and managing these seemingly conflicting regulations can be all too confusing.  This session will detail the governmental regulations relating to employee absences and provide guidelines for compliance. 
During an interactive session, real workplace examples will be shared, openly discussed and decisions reached about each mock employee’s rights regarding employment continuation and/or job protection.  Attendees will learn when, after exhausting all of the controlling regulations, it is finally appropriate to end the employment relationship with an absent employee. 
The specific learning objectives for attendees are to be able to:

Identify the employment protection provisions of various regulations
Recognize emerging trends regarding leave in excess of that allowed by FMLA as a form of reasonable accommodation
Safely recommend termination of an absent employee.

BIO

With many years of senior-level human resources experience in the private sector environment, Joyce Chastain brings practical know-how to each engagement.  As a human resources consultant, she specializes in talent development, employee relations, internal investigations, employment law compliance, and affirmative action plans.  She is a frequent guest speaker for professional associations and academia covering a wide array of human resources topics.

Ms. Chastain holds a Business Administration degree from Emmanuel College, Franklin Springs, GA; was awarded Senior Professional in Human Resources (SPHR) designation by the Human Resources Certification Institute and holds an Advanced Certificate in Internal Investigations.

She has served on the board of the HR Florida State Council since 2007 and currently serves as President.  Additionally, she has served as a:

Member of the Florida State University Center for Human Resource Management;
Board Member of the Big Bend Society for Human Resource Management;
Board Member of the Big Bend Business Leadership Network; and
Mentor in the Society for Human Resource Management Program.
 
Ms. Chastain has been named a Tallahassee Volunteer of the Year Finalist and Leon County Schools Volunteer of the Year.  She was selected as one of the “Twenty-five Women You Should Know in Tallahassee” and was honored with the designation of the Florida Human Resources Professional of the Year.  She has also been featured by the Florida Trend Magazine as a Trendsetter in Human Resources.
